These Terms of Service (“Terms”) are a contract between you and SnackKing LLC, doing business as Ethos Method (“we,” “us”).

1. Agreement to these Terms
By downloading, accessing, or using the Ethos Method mobile application for iOS and Apple Watch (the “App”) or related websites or services we operate, you agree to these Terms. If you do not agree, do not use the App.
2. The service
The App provides tools to plan, log, and analyze strength and conditioning activities. Features may change over time. We do not guarantee uninterrupted or error-free operation.
3. Accounts and eligibility
Where the App uses sign-in or synced data, you agree to provide accurate information and keep credentials secure. You are responsible for activity under your account. You must be old enough under applicable law to enter into these Terms.
4. Purchases and subscriptions
Paid features (including Ethos Method Pro or similar offerings) may be offered through Apple’s In-App Purchase system. Payment, renewal, cancellation, and refunds are governed by Apple’s terms and policies, except where law requires otherwise. We do not receive or store your full payment card details for those purchases.
5. Health and fitness disclaimer
The App is for informational and training-planning purposes only. It is not medical advice, physical therapy, or a substitute for professional care. Consult a qualified professional before starting or changing an exercise program. You assume the risks of physical activity.
6. Acceptable use
You agree not to:
- Use the App in violation of law or third-party rights.
- Attempt to probe, scan, or test the vulnerability of our systems, or bypass security.
- Reverse engineer, decompile, or disassemble the App except where applicable law permits.
- Use the App to transmit malware, spam, or harassing content.
- Resell, sublicense, or redistribute the App or its content without permission.
7. Intellectual property
The App, branding, and content we provide are owned by us or our licensors and are protected by intellectual property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable license to use the App as offered. No other rights are granted.
8. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.
10. Indemnity
You will defend and indemnify us and our officers, directors, employees, and agents against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the App or violation of these Terms, except to the extent caused by our misconduct.
11. Termination
We may suspend or terminate access to the App if you materially breach these Terms or if we discontinue the service. Provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Washington, USA, excluding conflict-of-law rules. Courts in Washington may have exclusive jurisdiction over disputes, subject to mandatory rights you may have under the laws of your country of residence.
13. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms and change the “Last updated” date. If changes are material, we will provide additional notice as required by law or by platform rules. Continued use after the effective date may constitute acceptance of the updated Terms.
